Newtown Township Planning Commission Meeting

The Newtown Township Planning Commission met via ZOOM on Tuesday, June 15, 2021. In attendance and voting were Chairman Allen Fidler, Secretary/Treasurer Mary Donaldson and members Warren Dallas, Craig Deutsch, Joel Raab, Amber Ray and Kierstyn Zolfo. Also in attendance were Solicitor Gerald Schenkman and Planner Mary Stover.

Condition Use Applications:
- Five Guys Burgers & Fries (2804 South Eagle Road in the Village at Newtown Shopping Center; where Salad Works is currently located).
- The Halal Guys (2820 South Eagle Road in the Village at Newtown Shopping Center; where Melt Shop is currently located).
Also discussed: Wescorp, located at 1 Pheasant Run in Newtown, PA, presented its plan for a reconstruction project and that would "upgrade" two signs - one facing Pheasant Run and one facing Penn Street above the entrance. Listen to that portion of the hearing.
The space is 2300 square feet with seating for 23 indoors and ten outdoors. Maximum of 8 employees expected. Hours of operation: Monday-Sunday, 11 AM to 10 PM.
Mr. Blackburn ... pointed out that the restaurant will have five two-top tables on the deck area in the front of the building and will remove these if they interfere with the use of the front door.
Mr. Fidler asked if there would be a difference in traffic and in foot traffic for a burger restaurant instead of the former salad restaurant. He was concerned particularly with intermingling with the Starbucks traffic. Mr. Blackburn noted that the peak hours for this restaurant would be at noon and early evening and will not be open in the morning, when Starbucks is busiest.
Mr. Dallas moved to recommend that the Board of Supervisors approve this application for a conditional use for Use E-5 and E-6, eating place and eating place/take out for Rockham 5G, LP (Five Guys), subject to certain conditions including compliance with the June 2, 2021 CKS Engineering letter and ADA compliance. Mr. Deutsch seconded and the motion passed 7-0.
Mr. Blackburn noted that the previous tenant had an approval for 43 seats in a 1600 square foot restaurant. Halal Guys will have only 18 seats. Application indicates 4-5 employees per shift, 2 shifts. Hours of operation: Monday-Sunday, 9 AM to 11 PM.
The Commission members discussed whether the applicant should ask for more seating to have it available if it is needed. Giray Patel, proprietor, said that all of the space is needed for prep work and cooking. The proposed 18 seats will be sufficient.
Ms. Ray moved to recommend that the Board of Supervisors approve this application for a conditional Use for uses E-5 and E-6, eating place and eating place/take out for MMA Newtown, LLC (Halal Guys) subject to a certain conditions including compliance with the June 2, 2021 CKS Engineering letter and ADA compliance. Ms. Donaldson seconded and the motion passed 7-0.
